1. General provisions

   1. 1. This Privacy Policy sets out the rules for the processing of personal data via the website available at https://2daystay.com (hereinafter referred to as the “ Website ”).

The Privacy Policy constitutes the implementation of the obligations incumbent on the Controller in connection with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), commonly known and in this document as ” GDPR “.

2. Methods and purposes of processing personal data

   1. 1. The use of the Website involves the processing of Users’ personal data for the following purposes:

         1. Contacting the Controller – for this purpose, the User provides their telephone number, email address, first and last name, and other data contained in the message. Providing an email address or telephone number is voluntary, but necessary to contact the Controller. In this case, personal data are processed for the purpose of contacting the User, and the basis for processing is the User’s consent resulting from initiating contact (Article 6, paragraph 1, letter a of the GDPR). The data may also be processed after contact with the Controller has ended. The legal basis for such processing is the legitimate purpose of archiving correspondence for the purpose of demonstrating its progress in the future (Article 6, paragraph 1, letter f of the GDPR).

         2. The use of Cookies on the Website is based on the User’s consent (Article 6, paragraph 1, letter a of the GDPR).

         3. Analyzing data collected automatically when using the Website – in this case, personal data are processed on the basis of the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR).

         4. Processing for archival and evidentiary purposes, for the purpose of securing information that may be used to prove facts – this is the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR).

         5. Confirmation of the performance of the Controller’s legal obligations and the pursuit of claims or defense against claims that may be brought against the Controller, as well as for the purpose of preventing or detecting fraud – based on the Controller’s legitimate interest in protecting rights, confirming the performance of obligations and obtaining due remuneration from Users in this respect (Article 6, paragraph 1, letter f of the GDPR).

         6. Sending the Newsletter – pursuant to Article 6(1) of the GDPR, i.e. the User’s consent given just before subscribing to the Newsletter, and for the purpose of direct marketing addressed to Users, pursuant to Article 6(1)(f) of the GDPR, i.e. the legitimate interest of the Controller.

      2. Personal data is not processed for the purpose of automated decision-making without the express consent of Users.

3. Sharing personal data

4. Period of storage of personal data

   1. 1. Personal data will be stored for the period necessary for the purpose for which they were collected, but no longer than 10 years from the date of collection.

5. User rights in connection with the processing of personal data

   1. 1. Pursuant to the GDPR, the User has the following rights in connection with the processing of his or her personal data:

         1. The right to information about how personal data is processed;

         2. The right to access and rectify personal data;

         3. The right to delete personal data; the Controller may refuse to delete data for which it has grounds for further processing (e.g., compliance with a legal obligation or pursuing or defending against claims that may be brought against the Controller);

         4. The right to request restriction of the processing of personal data;

         5. The right to object to the processing of personal data if the basis for processing is the legitimate interest of the Controller or the performance of tasks in the public interest;

         6. The right to withdraw consent if personal data were processed based on the User’s consent;

         7. The right to transfer personal data.

      2. All of the above rights can be exercised by contacting the Administrator via email. Submitted requests will be processed without undue delay, no later than 30 days from the date of receipt of the request. Within this timeframe, the Administrator will provide a response or inform about a possible extension of the deadline and explain the reasons. If the Administrator has doubts as to whether a specific request was submitted by an authorized person, they may ask several additional questions to verify the identity of the requestor.

Zgromadzone w ten sposób informacje są najczęściej przekazywane do serwera Google w Stanach Zjednoczonych i tam przechowywane. Z uwagi na aktywowaną przez Administratora anonimizację adresu IP, adres IP Użytkownika jest skracany przed przekazaniem dalej. Tylko w wyjątkowych przypadkach pełny adres IP jest przekazywany do serwera Google w Stanach Zjednoczonych i dopiero tam skracany. Zanonimizowany adres IP przekazany przez przeglądarkę Użytkownika co do zasady nie jest łączony z innymi danymi Google. Z uwagi na to, że Google LLC posiada siedzibę w USA i wykorzystuje infrastrukturę techniczną znajdującą się w USA, przystąpił do programu EU-US-Privacy Shield w celu zapewnienia odpowiedniego poziomu ochrony danych osobowych wymaganego przez RODO. W ramach umowy pomiędzy USA a Komisją Europejską, potwierdzono odpowiedni poziom ochrony danych w przypadku przedsiębiorstw posiadających certyfikat Privacy Shield. Aby zapobiec rejestrowaniu zgromadzonych przez ten rodzaj Cookies danych przez Google, jak również przetwarzaniu tych danych przez Google, Użytkownik może zainstalować wtyczkę do przeglądarki znajdującą się pod adresem: https://tools.google.com/dlpage/gaoptout. Szczegóły związane z przetwarzaniem danych w ramach Google Analytics dostępne są pod adresem https://support.google.com/analytics/answer/6004245.

      Korzystanie ze Strony wiąże się z przesyłaniem zapytań do serwera, na którym przechowywana jest Strona. Każde zapytanie skierowane do serwera zapisywane jest w logach serwera. Logi obejmują m.in. adres IP użytkownika, datę i czas serwera, informacje o przeglądarce internetowej i systemie operacyjnym Użytkownika. Logi zapisywane i przechowywane są na serwerze. Dane zapisane w logach serwera nie są kojarzone z konkretnymi Użytkownikami i nie są wykorzystywane przez Administratora w celu identyfikacji Użytkowników. Logi serwera stanowią wyłącznie materiał pomocniczy służący do administrowania Stroną, a ich zawartość nie jest ujawniana nikomu poza osobami upoważnionymi do administrowania serwerem.

      9. Bezpieczeństwo i organ ochrony danych osobowych

         1. 1. Administrator gwarantuje poufność wszelkich przekazanych mu danych osobowych. Administrator zapewnia podjęcie wszelkich środków bezpieczeństwa i ochrony danych osobowych wymaganych przez przepisy prawa. Dane osobowe są gromadzone z należytą starannością i odpowiednio chronione przed dostępem do nich przez osoby do tego nieupoważnione.

            2. Jeśli uważasz, że Administrator przetwarza dane osobowe niezgodnie z prawem, możesz wnieść skargę do właściwego organu, którym jest Prezes Urzędu Ochrony Danych Osobowych.
